1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and EIPC ("we," "us," or "our") regarding your use of our digital reading platform, website, mobile applications, and related services (collectively, the "Service").

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

2. Eligibility

2.1 Age Requirements

EIPC is designed for children aged 12 and under. To use our Service:

• If you are 18 years or older, you may create an account and use the Service
• If you are under 18, a parent or legal guardian must create and manage the account
• Parents or guardians are responsible for all activities under their account, including child profiles

2.2 Parental Consent

In compliance with COPPA (Children's Online Privacy Protection Act), we require verifiable parental consent before collecting personal information from children under 13. Parents must authorize all child profiles and activities.

3. Account Registration and Security

3.1 Account Creation

To access EIPC's full features, you must:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Create a strong password and keep it confidential
• Accept responsibility for all activities under your account

3.2 Account Security

You agree to:

• Not share your account credentials with others
• Notify us immediately of any unauthorized access
• Not create accounts for anyone other than yourself without permission
• Not use another person's account without authorization

4. Subscription and Payment

4.1 Subscription Plans

EIPC offers various subscription plans:

• Free Basic: Limited access to content and features
• Premium Unlimited: Full access to all content and features
• Educator Accounts: Free for verified teachers during school hours

4.2 Payment Terms

• Subscription fees are billed in advance on a monthly or annual basis
• You authorize us to charge your payment method for all fees
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days' notice
• Failed payments may result in service suspension or termination

4.3 Free Trial

We may offer a free trial period. You will be charged the subscription fee after the trial ends unless you cancel before the trial period expires. Cancellation must be completed at least 24 hours before the trial ends to avoid charges.

4.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• You will retain access until the end of the paid period
• Refunds are provided only in cases of technical errors or as required by law
• Partial refunds for unused portions of a subscription are not provided

5. Content and Intellectual Property

5.1 Our Content

All content on EIPC, including books, audiobooks, videos, graphics, logos, and software, is owned by EIPC or our content partners and is protected by copyright, trademark, and other intellectual property laws.

5.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to:

• Access and use our Service for personal, non-commercial purposes
• Stream and download content for offline viewing (where applicable)
• Create up to 4 child profiles per family account

5.3 Restrictions

You agree NOT to:

• Copy, modify, distribute, or sell any content from EIPC
• Use automated tools (bots, scrapers) to access our Service
• Circumvent any security or access control measures
• Share your account with individuals outside your household
• Remove or alter copyright notices or watermarks
• Use content for commercial purposes
• Frame or mirror any part of the Service

6. User Conduct

You agree to use EIPC in a lawful and respectful manner. Prohibited activities include:

• Violating any laws or regulations
• Infringing on the rights of others
• Transmitting malware, viruses, or harmful code
• Attempting to gain unauthorized access to our systems
• Interfering with the proper functioning of the Service
• Impersonating others or providing false information
• Harassing, threatening, or abusing other users or staff
• Using the Service for any illegal or unauthorized purpose

7. Educator Accounts

7.1 Eligibility

Educator accounts are available to verified teachers, librarians, and educational professionals for use in classroom settings during school hours.

7.2 Verification

We reserve the right to verify educator status and may request documentation such as school email addresses, employment verification, or teaching credentials.

7.3 Permitted Use

Educator accounts may be used to:

• Assign reading materials to students
• Track student reading progress
• Create and manage student profiles
• Use content for educational purposes in the classroom

8. Third-Party Content and Links

Our Service may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these external sites. Your use of third-party services is subject to their terms and policies.

9. Service Availability and Modifications

9.1 Service Availability

We strive to provide uninterrupted access to EIPC, but we do not guarantee that the Service will always be available or error-free. We may experience downtime for maintenance, updates, or due to circumstances beyond our control.

9.2 Right to Modify

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service
• Update or remove content from our library
• Change features, functionality, or pricing
• Impose limits on certain features or access

We will provide reasonable notice of material changes when possible.

10. Termination

10.1 Your Right to Terminate

You may terminate your account at any time by canceling your subscription through account settings or by contacting customer support.

10.2 Our Right to Terminate

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Fail to pay subscription fees
• Pose a security or legal risk
• Provide false information

We will provide notice before termination when possible, except in cases of serious violations or legal requirements.

10.3 Effect of Termination

Upon termination:

• Your access to the Service will cease immediately
• Downloaded content will no longer be accessible
• Account data may be deleted after 90 days
• Outstanding fees remain due and payable

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, completeness, or reliability of content
• Uninterrupted or error-free operation
• Security or freedom from viruses

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EIPC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to EIPC in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless EIPC and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any laws or regulations

14. Dispute Resolution

14.1 Informal Resolution

If you have a dispute with EIPC, please contact us first at support@eipc.cc to attempt to resolve the issue informally.

14.2 Arbitration Agreement

If we cannot resolve a dispute informally, any claims will be resolved through binding arbitration, rather than in court, except where prohibited by law. You agree to waive your right to a jury trial or to participate in a class action lawsuit.

14.3 Exceptions

This arbitration agreement does not apply to:

• Claims related to intellectual property rights
• Small claims court proceedings
• Claims that cannot be arbitrated under applicable law

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions. Any legal action related to these Terms must be brought in the courts located in [Your Jurisdiction].

16. Changes to Terms

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or technical failures.
